1. Purpose of this Notice

This privacy notice (“Notice”) describes how Euro Broadband Infrastructure Sarl, based in Nyon, Business Park Route de Crassier 7 1262 Eysins, Switzerland (“EBI”), in its capacity as data controller (“Data Controller”), collects, uses, processes and transfers your personal data, as described in detail below.

Personal Data” means any information relating to an identified or identifiable natural person, collected or otherwise received by the Data Controller. The Data Controller processes any Personal Data fairly, lawfully, and in accordance with all applicable laws.

2. Personal Data that the Data Controller collects

The Data Controller may collect your Personal Data, including but not limited to name and surname, and contact data (such as telephone number, email address), in case you require to be contacted for information on its products and services and, in any case, for the purposes of the data processing defined under article 3 below. The provision of your Personal Data is, therefore, voluntary but, in case of your refusal, it will not be possible to reply to your information requests.

3. Use of Personal Data

The Data Controller will process your Personal Data exclusively in order to respond to your request of information about EBI’s services and products (the applicable lawful basis for processing is, therefore, the need to take steps at the request of a data subject prior to entering into a contract). For this same purpose, and in case it is necessary to reply to your information requests, your data may be communicated to EBI’s distributors, which will act as independent data controllers.

Your personal data may be communicated also to our service providers, which will act as data processors in compliance with the data processing agreements entered into pursuant to the applicable laws and regulations.

4. Data Security and Data Processing Conditions

The Data Controller endeavors to maintain all the physical, technical and organizational security measures necessary to protect Personal Data against accidental or unlawful destruction, or accidental loss, alteration, unauthorized disclosure, use or access, in compliance with all applicable laws. Personal Data is processed electronically and also manually according to methods and procedures consistent with the above mentioned processing purposes.

5. Data Retention

The Data Controller will retain your Personal Data only for the time necessary for the purposes for which the Personal Data were collected or as required by law and, unless you purchase EBI’s products and services, your Personal Data will be deleted within 6 months from our last interaction.

6. Access to Personal Data and other Privacy Rights

Data protection law grants you several rights concerning your Personal Data. The Data Controller undertakes to protect your Personal Data and comply with applicable data protection law.

Rights What does it mean?
1. Right to be informed The user/data subject has the right to receive clear, transparent and easily understandable information about how and why his or her data are being processed and about his or her rights. This is the reason why the information included in this privacy notice is provided.
2. Right of access The user/data subject has the right to get access to his or her personal data that are being processed and other information (similar to the ones provided in the present privacy notice). The purpose is to make sure that the user/data subject is aware of and can check whether its own personal data are used in compliance with data protection law.
3. Right to rectification The user/data subject has the right to ask for modifications to his or her personal data in case they are inaccurate or incomplete.
4. Right to erasure Also known as “right to be forgotten”, this right provides the user/data subject with the ability to ask for the deletion of  his or her data whenever there is no longer a reason to use them . It is important to note that this is not a general right to erasure as  exceptions do exist.
5. Right to restriction of processing The user/data subject has the right to ‘stop’ or restrict the further use of the information. When the data processing is restricted, the company can keep and store the information, but cannot further use them. The company keeps a list of the people who requested the restriction so to make sure that the restriction will be fulfilled in the future.
6. Right for data portability The user/data subject has the right to ask for his or her personal data to be provided back to him or her and re-use said data for his or her own purposes across different service. For example, if the user/data subject decides to move to another supplier, this right allows moving, copy or transferring personal data easily from one IT-environment to another in a safe and secure way, without affecting its usability.
7. Right to object to the processing The user/data subject has the right to object to the processing of his or her personal data for direct marketing purposes (upon prior consent) and also to the processing made in order to protect the legitimate interests of the company.
8. Right/faculty to lodge a complaint The user/data subject has the right to lodge a complaint with the national data protection authority about the way the company processes or handles personal data.
9. Right to withdraw consent In case the user/data subject gave his or her consent to any activity with his or her personal data, he or she has the right to withdraw said consent at any time (although said withdrawal shall not affect the lawfulness of processing based on consent before the withdrawal).This includes the right to withdraw consent to the use of personal data for direct marketing purposes.
